The Immigration, Asylum and Nationality Act (2006) makes it a criminal offence to employ someone who does not have the right to work in the U.K

All employers have a legal responsibility to perform identity checks on all people employed by them.

The Act requires that Right to Work checks must be carried out before an employee starts work for you. An NI number is not sufficient proof of the right to work and must be accompanied by another approved document. Employers are at risk of prosecution if they are found to be employing workers illegally.
